By accessing or using StarReply ("the Service"), operated at www.getstarreply.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. These terms apply to all users of the Service, including business owners, managers, and other authorized personnel.
2. Description of Service
StarReply is an AI-powered review response platform for local businesses. The Service generates suggested responses to customer reviews submitted by users. These AI-generated responses are suggestions only and should be reviewed by the user before being posted publicly. StarReply does not post responses automatically on your behalf in the current version of the Service.
3. Account Registration
To use the Service, you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account. You must be at least 18 years old and have the authority to bind the business you represent to these terms.
4. Subscription and Billing
StarReply offers paid subscription plans billed monthly. All payments are processed securely through Stripe. Prices are listed in US Dollars (USD). You may cancel your subscription at any time, and cancellation will take effect at the end of the current billing period. We reserve the right to change our pricing with 30 days notice to existing subscribers. A 14-day free trial is available for new accounts.
5. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to: submit false, misleading, or defamatory review content; use the Service to generate responses that violate any applicable laws or regulations; attempt to reverse-engineer, decompile, or disassemble any part of the Service; share your account credentials with unauthorized third parties; or use the Service in any way that could damage, disable, or impair the Service.
6. AI-Generated Content
The review responses generated by StarReply are created using artificial intelligence and are provided as suggestions only. You are solely responsible for reviewing, editing, and approving any AI-generated response before posting it publicly. StarReply does not guarantee that AI-generated responses will be appropriate for every situation. You acknowledge that AI-generated content may occasionally contain errors or inappropriate suggestions, and you agree to review all content before use.
7. Intellectual Property
The Service, including its design, features, and content (excluding user-submitted data), is owned by StarReply and is protected by intellectual property laws. You retain ownership of any review content you submit to the Service. You grant StarReply a limited license to process your submitted content solely for the purpose of providing the Service. AI-generated responses become your property once generated and may be used freely by you.
8. Limitation of Liability
To the maximum extent permitted by law, StarReply shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of the Service. Our total liability for any claims arising under these terms shall not exceed the amount you paid to StarReply in the twelve months preceding the claim. The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.
9. Termination
We may terminate or suspend your account and access to the Service at our sole discretion, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease. You may request export of your data within 30 days of termination by contacting support@getstarreply.com.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting a notice on our website and updating the "Last updated" date. Your continued use of the Service following any changes constitutes acceptance of the revised Terms.
